As long as Anwar remains as PM, divorce declaration cannot be withdrawn
SHAH ALAM - The taklik (conditional divorce) of an individual wanting to divorce his wife at three talaks if Prime Minister Datuk Seri Anwar Ibrahim and the unity government remained in power, would continue to hold until August and will be unable to be withdrawn.
Religious Affairs Minister Datuk Dr Mohd Na’im Mokhtar said from the statute, any taklik could not be withdrawn when stated.
He said under the law it clearly outlines that any application to confirm a declaration must be filed in Syariah Court as allocated in the state enactments.
“It’s advised for husband or wife involved to file an application in court to confirm the divorce.
“Only the Syariah judge from where the couple resides can determine whether the taklik is applicable or not,” he said in a video uploaded on his Facebook on Friday.
Mohd Na’im said such when he was asked to comment on a man in February informing he would divorce his wife at three talaks if the Prime Minister and government did not change in August.
The issue became viral on social media and the question arose whether the divorce declaration would be accepted or not after August.
He commented and explained that when the taklik with a divorce of three talaks to a wife was stated, it was an irresponsible statement as the wife could not be made into an object or exchanged for a taklik.
“The wife should be treated with dignity. Islam itself elevated the status of a wife and women,” he added.
Mohd Na’im advised husbands to be responsible and not involve a wife’s pride in declaring a taklik.
“Secondly, if you want to confirm whether the declaration falls through or not, do not refer to a third party.
“The one that can decide whether it was confirmed or not is the Syariah court judge ,” he said.
