Enactment of new ruling proposed to enable dismissal, impeachment of PM
PETALING JAYA - A new Dewan Rakyat ruling must be enacted to allow the motion to dismiss and impeach the prime minister.
Dewan Negara Yang Dipertua Tan Sri Wan Junaidi Tuanku Jaafar stated that the matter would be discussed with Dewan Rakyat Speaker Tan Sri Johari Abdul to facilitate the examination of this rule.
"Similar laws exist in countries like the United Kingdom (UK), where former Prime Minister Tony Blair faced impeachment in 2004," Wan Junaidi highlighted.
“We (Malaysia) do not have (prosecution law) and it should be introduced as England had done so since the 1800s.
"We must have a rule in place where a vote of confidence or no confidence towards the government requires a notice to be filed in the Dewan Rakyat," Wan Junaidi stated during a speech at the forum titled 'Political Stability in a Hung Parliament' on Tuesday.
The term "proceedings to impeach" refers to charges of misconduct made against public servants.
As a former law minister, Wan Junaidi suggested that Opposition chief Datuk Seri Hamzah Zainuddin bring this suggestion forward as a private bill in the near future.
He also urged the enactment of an act to establish a parliamentary deadline, further enhancing the existing Anti-Hopping Law.
"This is the only way to allow a minority government to continue. Only Parliament can decide when elections will be held," Wan Junaidi added.
"However, if two-thirds of MPs agree to hold elections, then they will be conducted. If not, the minority government will continue its administration," he said.
