SPM graduate accused of rape, and possession of pornographic video of lover

MELAKA - A Sijil Pelajaran Malaysia (SPM) graduate was brought before the Sessions Court and Magistrate court here on Friday on the charges of rape and owning pornographic videos on his phone.

Muhammad Isa Muhaimim Mohamad Fauzi, 18, pleaded not guilty after the four charges were read separately in front of Judge Dharmafikri Abu Adam and Magistrate Sharda Shienh Mohd Suleiman.

He was accused of raping a 15-year-old girl.

The act was done in Taman Limbongan Permai here between September 2022 to May 2023.

If found guilty a person can be sent to prison for up to 20 years and be subjected to whipping according to Section 376 (1) of the Penal Code

It was understood that the video recording was between the accused and his lover.

The charges read in front of Sharda had the accused charged with possession of the phone containing the pornographic video making it an offence under Section 292 of the Penal Code.

The prosecution handled by Deputy Prosecutor N Sivashangari proposed a bail of RM20,000 while J. Banusha proposed a bail of RM8,000.

The accused represented by lawyer Goh Chin Han pleaded for a lower bail as the accused was unemployed and had recently finished his studies and relied on the income of his father who was a lorry driver.

The court ordered the accused to be placed on a bail totalling RM14,000 and set June 19, for the remention of the case and document submissions.
