Adib's family withdraws contempt suit against Tommy Thomas

PUTRAJAYA - The family of the late firefighter Muhammad Adib Mohd Kassim has withdrawn their appeal to prosecute former Attorney General Tommy Thomas on the charges of contempt of court.

Tetuan Mohd Zubir Embong & Associates law firm that represents the family said the decision was made by Adib's family as they do not want to prolong the case.

"Following the instructions from Adib's family, the father, Mohd Kassim Abdul Hamid's has appealed to pull back, lawyers have filed a Notice of Withdrawal of Appeal on May 31, Attorney General Chambers (AGC) that represented Tommy Thomas filed the withdrawal of appeal on Tuesday,"

According to the law firm, Adib's family hoped the process and proceeding over the contempt of court against Thomas and AGC would end here.

"They hoped the public will allow the family to continue their lives forward," it said in a statement.

The firm stated, there are three appeals in progress at the Court of Appeal. "Firstly, it is the appeal by AGC to clarify coroner's judge has no jurisdiction to hear and sentence anyone, including Tommy Thomas, for contempt of court," it added.

While the other two appeal of Adbi's father, Kassim, 66 to challenge the high court's decision ruled that Thomas had the right of appeal and his appeal was accepted.

The firm added the Court of Appeal Panel had rejected the appeal on Feb 8 2022. The AGC had then filed the application to allow the appeal to the Federal Court, the highest courts in the country.

"Two other appeals by Adib's father have been suspended, pending an appeal process to the Federal Court by AGC," he said.

Adib was attached with the Subang Jaya Fire and Rescue Service (EMRS) was injured during a riot at Sri Maha Mramman temple, USJ 25, Subang Jaya on Nov 27, 2018.

After 21 days of fighting for his life, he died on Dec 17, 2018 in Institut Jantung Negara (IJN)
