SHAH ALAM - Emilia Hanafi, former wife of Naza group chairman Datuk SM Faisal SM Nasimuddin has been released early from her seven-day jail sentence in Kajang Prison today.
This was confirmed by one of her lawyers, Siti Zabedah Kasim or popularly known as Siti Kasim.
"Yes, Emilia is released,” she told Sinar Daily.
Siti Kasim added that it was normal for people to serve only a one-third of their sentence.
When asked what was next for Emilia, she said it was under the jurisdiction of her Syariah lawyer Nazri Yahya and Nizam Bashir as they were aware of what she was currently facing in the courts with the onslaught of cases filed against her by her ex-husband.
"At least now, she can attend all of the cases, especially the domestic violence case against her ex in Magistrate 3 Kuala Lumpur Court.
"(There is) no fear of being arrested by the Syariah police now,” she said.
On Sept 4, 2019, the mother of three was handed down the jail sentence by Syariah court for unilaterally rescheduling the visitation dates for her children to be with their father as well as not adhering to a court order regarding visitation rights.
Syariah judge Mohamed Fouzi Mokhtar made the order after allowing a contempt of court application filed by Faisal against Emilia and was granted a RM5,000 bail pending her appeal.
On June 8, Emilia filed a judicial review application to challenge the Syariah High Court's jurisdiction to hand down the sentence to her.
The jail sentence then took effect on June 27 after she surrendered herself to the Syariah High Court.
Emilia, 43, dressed in a white long dress and shawl, arrived at the Syariah Court at 9.50am accompanied by her lawyer and family members. She served a total of five days and four nights in prison.
